REQUEST SECTION 184 CERTIFICATE

HOW DO I ORDER A CERTIFICATE?

When a strata titled property is sold, the seller must obtain a statement of levy positions (information certificate) from the strata manager in accordance with Section 184 of the Strata Schemes Management Act 2015.

The information certificate is used for the purposes of settlement and gives information about the strata scheme including:

  • the names and addresses of the strata committee members, the strata managing agent and building manager (if applicable);
  • the levies to be paid by the owners;
  • any outstanding levies;
  • the address where the records and financial statements can be viewed;
  • any special by-laws made by the owners corporation in the past six months;
  • building insurance policies;
  • the proposals for funding matters set out in the 10 year capital works fund plan; and
  • whether or not a strata renewal committee has been established.

FEES & PAYMENT

Statutory fees apply for the provision of these certificates.

  • Section 184 (strata schemes):  $119.90 incl GST per lot and $59.95 incl GST per utility lot
  • Section 26 (community title):  $103.40 incl GST per lot

ACCESS TO STRATA SCHEME RECORDS

S184 of the Strata Schemes Management Act 2015 states that any lot owner, mortgagee or covenant charge may request the owner’s corporation to allow an inspection of the books and records to be carried out. These inspections are usually carried out prior to a property sale and mostly by professional companies.
